Terms and Conditions of Sale

These terms apply when a consumer buys goods from Adam Camp, trading as FishBarn Pottery ("we", "us" or "our") through https://www.fishbarnpottery.co.uk. Please read them before ordering and save a copy for your records.
Nothing in these terms limits rights that cannot lawfully be excluded under UK consumer law.

2. Products
We sell handmade pottery. Product pages describe the material, dimensions, care, function and safety information known for each piece and show photographs of the individual item offered for sale.
Handmade pottery naturally includes variations in shape, glaze, texture and colour. These are part of the piece rather than manufacturing defects when they are consistent with the photographs and description. Screen settings and lighting can also affect how colours appear.
3. Prices and delivery charges
Prices are displayed in GBP (pounds sterling) and include any taxes that we are required to include. Delivery is charged separately unless the product page or promotion says otherwise. The total price, including compulsory charges and delivery, is displayed before you place the order.
4. Placing an order
The checkout allows you to review the items, delivery details and total price and to correct errors before payment. The final checkout button makes clear that placing the order creates an obligation to pay.
After you order, we will send an electronic acknowledgement. This confirms receipt but does not necessarily mean we have accepted the order. A binding contract is formed when we send an order confirmation or dispatch confirmation, whichever we identify as acceptance in the checkout process.
We may decline or cancel an order before acceptance if, for example, the item has already sold, its price or description contains an obvious error, payment is not authorised, or we cannot deliver to the requested address. If payment has been taken, we will refund it promptly.
The contract is concluded in English. The order confirmation and these terms can be saved or printed for your records.
5. Payment
Payment methods are shown at checkout and payments are processed securely by Stripe. Payment is taken in GBP. We do not receive or store your full card number. You must be authorised to use the payment method supplied.
The name shown on your card or bank statement should be [FISHBARN POTTERY]. Contact us promptly if you do not recognise a charge.
6. Delivery
Delivery destinations, methods, charges and estimated timings are explained in our Shipping Policy, which forms part of these terms. Unless a different period is agreed, goods will be delivered without undue delay and within 30 days after the contract is entered into.
7. Cancellation, returns and refunds
Your cancellation rights and the process for returns, damaged goods and refunds are set out in our Returns, Cancellations and Refunds Policy, which forms part of these terms.
8. Ownership and responsibility for goods
We remain responsible for goods until they are delivered to you or a person you nominate, except where you arrange a carrier not offered by us. You own the goods once we have received payment in full and the goods have been delivered.
9. Product care and safety
Follow the care and safety information on the product page. Functional stoneware pieces are food-safe and dishwasher-safe unless stated otherwise, but hand washing is recommended for large, lidded, sculptural or delicate forms. Never leave a burning candle unattended, keep candles away from children, pets and flammable materials, and place candlesticks on a stable, heat-resistant surface.
10. Our responsibility
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for business losses arising from a consumer purchase, or for damage caused by misuse or failure to follow clear care instructions.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory rights relating to faulty or misdescribed goods.
11. Events outside our control
We are not responsible for delay caused by an event outside our reasonable control. We will contact you as soon as reasonably possible, take steps to minimise the effect, and explain your options where the delay is substantial.
12. Complaints
Contact support@fishbarnpottery.co.uk or [SUPPORT PHONE] with your name, order number and a description of the issue. We aim to acknowledge complaints within two working days and provide a substantive response within ten working days where possible.
13. Personal information
We use personal information as described in our Privacy Policy.
14. Other important terms
If any provision is found unlawful or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right does not waive it. You may transfer your rights only where the law permits; we may transfer our rights and obligations only where this does not reduce your rights.
No person other than you and us has a right to enforce this contract, except where the law provides otherwise.
15. Governing law
These terms are governed by the law of ENGLAND AND WALES. If you are a UK consumer, you may bring legal proceedings in the part of the UK where you live, as permitted by law.
